Estate Planning & Elder Law for Lancaster

A home, acreage or a family business can carry both financial value and personal meaning. O'BRIEN LEGAL helps Lancaster residents plan for ownership transitions, family responsibilities and long-term care without assuming that every heir wants-or can manage-the same asset.

A fair inheritance does not always mean dividing every asset - decide who should own the property, how others should be treated and how the plan will remain workable.

Keeping property in the family takes more than good intentions

Before leaving land or a business to several children together, discuss how they would use it. One may want to continue operations, another may need cash and another may live far away. Shared ownership can become difficult without rules for management, expenses and a possible sale.

A succession plan can address who receives the property, whether another beneficiary receives different assets and how a buyout might work. Those choices depend on value, cash flow, ownership documents and your goals. We help coordinate estate planning and identify when additional business or tax advice is needed.

A deed transfer can change more than the owner's name

Giving a Lancaster County home or acreage to a child may reduce your control and create exposure to that child's financial circumstances. It can also affect tax treatment and future long-term care eligibility. Compare the consequences before signing a new deed.

For land subject to mortgages, leases, entity agreements or recorded restrictions, examine the underlying documents. If agricultural-use or conservation arrangements apply, obtain advice about their transfer requirements. Estate planning should fit the property's actual legal and financial conditions.

Inheritance tax deserves a separate property review

Do not assume that farm or family-business property is automatically free of Pennsylvania inheritance tax. Any available exemption has specific conditions, and qualification must be assessed. A trust or a non-probate transfer does not, by itself, establish a tax exemption.

Your plan should also consider how an estate will pay expenses if most of its value is tied up in real estate. Naming an executor is only one part of that problem; preserving workable options for that person matters too.

Plan for your own care before planning the transfer

You may want a child to receive the property eventually while retaining sufficient resources and decision-making support for yourself. Financial powers of attorney, health care documents and elder law planning belong in the same conversation as an inheritance.

We evaluate long-term care concerns using your health, household, income, assets and prior transfers. The right approach for an active landowner may differ from the available options when nursing-home care is imminent. Avoid acting on a general promise that a deed or trust will solve every concern.

Lancaster County probate: prepare the records

Lancaster County's Register of Wills publishes probate instructions and identifies documents needed to open an estate, including the death certificate, a will if one exists and a petition for letters. Additional materials may be required for a particular estate.

For an executor managing land, locate deeds, leases, account records and ownership agreements early. O'BRIEN LEGAL assists with Pennsylvania estate and trust administration and can help evaluate the steps required before property or funds are distributed.
